Lost the award? Debriefs, protests, and when to fight

Losing stings, but federal procurement gives you two things commercial markets rarely do: a legal right to feedback, and a referee. Used well, both make you sharper. Used badly, protests burn money and relationships. Here is the sober playbook.
Always take the debrief
On negotiated procurements you generally have three days from notification to request a debrief. You will learn your evaluated strengths and weaknesses and, often, the winner’s evaluated price. Go in with written questions, take notes, and skip the arguing — the goal is intelligence for the next bid, not relitigating this one. DoD’s enhanced debriefing process even allows follow-up questions after the session.
The protest decision
A protest challenges the agency’s process, not its taste. Viable grounds look like: the evaluation contradicted the solicitation’s stated criteria, unequal treatment of offerors, or material errors in the price analysis. “We were better” is not a ground.

The formal sustain rate is modest — 16% of GAO merit decisions in FY2024 — but agencies frequently take voluntary corrective action when a protest exposes a real flaw, which is why the overall “effectiveness rate” reached 52% that year. File within the timeliness windows (generally ten days from when you knew the basis; five days post-debrief for the automatic stay) or you lose the right entirely.

Outside counsel, weeks of distraction, and a buyer who now associates you with litigation. Protest when the process was genuinely broken and the contract matters — not to vent.
The quiet alternative
A polite post-debrief note to the contracting officer — thanking them and flagging your interest in future work — converts more losses into future wins than most protests do. The next requirement is usually already forming.
